One is under the Paternity Leave Act of 1996 and the other is under the Expanded Maternity Leave Law of 2019.

What is paternity?
Paternity means fatherhood. It means the state of being the father of a child.



1. Paternity Leave under the Paternity Leave Act of 1996 (RA 8187)


What are the requirements for you to be able to enjoy your leave?
You must be currently employed.
You must be legally married to the mother of your baby. She must be your legal wife.
You must notify your employer of your wife's pregnancy and her expected date of delivery.

How many leave days will you enjoy?
7 days of paid leave

When do you use your leave?
After your wife has given birth to your child. 
The purpose of your leave is for you to assist your wife during her recovery and to help care for your newborn baby.

Is there a limit to this paternity leave?
Yes. You enjoy this only for up to 4 deliveries (childbirth or miscarriage).


2. Paternity Leave under the Expanded Maternity Leave Law of 2019 (RA 11210)


What are the requirements for you to be able to enjoy this leave?
Your wife or partner must inform SSS how many leave days she will allocate to you. She will include this information in her SSS Maternity Notification, which can be in paper form or through her employer's online SSS account.
You must also notify your own employer your intention to use this paternity leave, the number of days and expected dates.

Is it required that you're legally married to the mother of your child?
No. Marriage is not a requirement.

How many days will you enjoy?
You and your partner will decide the number of days, from 1 day to 7 days. 
This number of days will be deducted from the 105 days granted under this Maternity Leave Law.

Can this leave be enjoyed if your partner miscarried or if the pregnancy was terminated?
No. Only if your partner gave birth to a child. 

When will you enjoy your paternity leave?
During your partner's maternity leave. Can be enjoyed continuously or intermittently.

Can you enjoy this if you're employed in the public sector?
Yes


All in all, you have 14 days to help your wife or partner recover and care for the newborn baby.
